Commitment: A: The coach is committed to providing you with the most exceptional results that if you follow through on all your minimum commitments stated in clause 4, and you are not satisfied with your results at the end of the program, then you are eligible for a full refund. B: Coach and client will meet on regular basis in person or via zoom. Coach and client will develop a coaching plan based on the client͛ s outcomes for coaching͘ C: Coach agrees to spend the appropriate amount of time in preparation for meeting with the client. D: Client agrees that coach may assign tasks to be done in between coaching sessions and that client will give their best efforts to fulfill these tasks. Client further agrees that if tasks are not done, the outcome of coaching cannot be predicted. 2. Refund Policy: The client can be eligible for a full or percentage refund only under exceptional circumstances agreed upon by The Coach. 3. Coach-Client Relationship - Duties & Responsibilities: A business and/or life coaching relationship is a partnership between two or more individuals or entities. This relationship is not a legal partnership, instead more like a teacher- student or coach-athlete relationship. Each party must uphold their obligations for the coaching relationship to be successful. A: Coach agrees to maintain the ethics and standards of behaviour that is expected of the professional. B: Client agrees to communicate honestly, be open to feedback and suggestions, and to fully engage and devote himself/herself to the coaching process. As well as notifying the trainer immediately if they feel any type of pain/unusual discomfort if following training advice. C: Client acknowledges and agrees that coaching is a comprehensive process that may explore different areas of his/her life, including work, finances, health and relationships, but it is ultimately the Client͛ s decision how he/she incorporates coaching into each aspect of life. D: By signing below, client hereby acknowledge & understand, that he/she either had a physical examination and been given a physicians permission to participate in this training program; or (ii) decided to participate in this training program without the approval of a physician. Client is solely responsible for implementing the techniques discovered through coaching. E: Client understands the involvement of physical activity in the coaching plan and, as appropriate, use of certain equipment and machinery. As with any physical activity, there are risks, including increased heart stress, the chance of musculoskeletal injuries & death. In volunteering for this training contract, you agree to assume responsibility for these risks and waive any possibility for personal damage. By signing below the client accepts full responsibility for their own health and well-being and voluntarily agrees to participate in these activities. Client assumes all risks of personal injury, death and property damage resulting from such activities, use of equipment, machinery or public or private facilities without Rani’s supervision͘. F: Client is solely responsible for the outcome of results; the coach agrees to give the methods that are believed to achieve results however in the circumstance that the client does not follow the protocols or health issues become an issue the coach will not be responsible for the client not reaching the expected result. G: Client understands that the results of any coaching will depend on their own ability to act and to follow the coaching plan to the best of client͛ s abilities, communicate clearly with the coach and to take responsibility for results achieved. The coach can only facilitate. The responsibility for making the process work is the clients alone and no one can do that for them. 4. Confidentiality: The Coach agrees not to disclose any information per training to the Client without the Client͛ s written consent. BE ADVISED: the Coach Client relationship is not a relationship protected by legal confidentiality (like doctor-patient or attorney-client). As such, the Coach could be required to divulge otherwise confidential information to authorities. A: Client agrees to share with the coach all issues on which the client needs assistance. B: Clients agree that issues not shared with coach may not be resolved or may impede the successful achievements of client͛ s goals and objectives͘. C: Coach agrees to use best efforts to assist client to resolve issues shared with coach and also agrees to full confidentiality. 5. Testimonials & Advertising.: The Client agrees that progress submission photos and testimonial videos, coaching calls may be used for promotional and advertising material. The Coach agrees to de-identify the client͛ s name and make the post anonymous unless otherwise consented to by the client. The client agrees and consents to aiding in the growth of the business by allowing transformations to inspire others to change their lives. 6. Termination of Agreement: Either party may terminate this Agreement at any time upon 28 days͛ written notice to the other party at the address provided above, once the full term of Clients contract is completed. 7. Limited Liability: A: Coach makes no guarantees, representations or warranties of any kind or nature, expressed or implied with respect to the coaching services negotiated, agreed upon and rendered. B: In no event shall the Coach or team be liable to the Client for any indirect, consequential or special damages. Not with standing any damages that the Client may incur, the Coach͛ s entire liability under this Agreement, and the Client͛ s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. C: Client agrees that the Coach is not liable or responsible for any actions or in actions, or for any director in direct result of any services provided by the Coach. D: Client understands that coach is not providing psychological or medical advice and that coaching should in no way replace sound treatment form a licensed health care provider. Your coach is not a medical doctor, psychologist, or psychiatrist. The services you receive are not regulated by a governmental body. We will only provide those services in which we have been trained, and if we find that we cannot help you, we will refer you to a person who can assist you. 8. Entire Agreement: This document reflects the entire agreement between the Coach and the Client and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered, or supplemented except in writing signed by both the Coach and the Client. 9. Dispute Resolution and Legal Fees: In the event of a dispute arising out of this Agreement that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorney’s fees. 10. Legal and Binding Agreement: This Agreement is legal and binding between the Parties as stated above. This Agreement may be entered into and is legal and binding in Australia. The Parties each represent that they have the authority to enter into this Agreement. By purchasing this deposit or payment plan, the client acknowledges that they have provided truthful information throughout this document and that this information is confidential and won͛ t be released to a third party without their consent. Furthermore, the client acknowledges that Evolution Coaching Official is neither a medical doctor, physiotherapist, psychologist, or dietician. Any information provided covering these areas are merely general education and/or recommendations and not intended to diagnose, cure or treat any disease. The Parties agree to the terms and conditions set forth above as demonstrated by their purchase.
